These Terms of Service ("Terms") govern your access to and use of the CerebralCrew website, early-access program, and — once generally available — the CerebralCrew platform itself (together, the "Service"), operated by CerebralCrew ("we", "our", or "us"). By registering your interest, requesting a demo, contacting our sales team, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Who these Terms apply to
These Terms apply to any individual or organization that visits our website, submits the early-access registration form, or, once available, subscribes to and uses the CerebralCrew platform (each, a "Customer" or "you"). If you are agreeing on behalf of a company or organization, you confirm you have the authority to bind that organization to these Terms.
2. Current stage of the Service
CerebralCrew is currently in a pre-launch, early-access phase. Submitting the registration form does not create an active account, does not grant access to the platform, and does not constitute a purchase or a binding subscription. It registers your interest so our team can contact you regarding demos, pricing, and onboarding. Features, integrations, and timelines referenced on our website or in conversations during this phase are provided for planning purposes only and may change before general availability.
3. Eligibility and account responsibility
CerebralCrew is intended for business use by organizations and their authorized representatives, and is not directed at individuals under the age of 18. By registering, you confirm that the information you provide (name, organization, email, phone/WhatsApp number) is accurate and current, and that you are authorized to register interest or, later, create an account on behalf of your organization. Once accounts are available, you will be responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
4. Acceptable use
You agree not to use the Service to: violate any applicable law or regulation; infringe the intellectual property or privacy rights of others; upload or transmit malicious code; attempt to gain unauthorized access to our systems or another user's data; use the Service to build a directly competing product; or interfere with the normal operation of the Service. We reserve the right to suspend or terminate access for any account found to be in violation of this section.
5. Your data and content
When you connect third-party systems to CerebralCrew (such as WhatsApp Business API, Telegram, HubSpot, Salesforce, Odoo, or Gmail), you retain ownership of your business data. We process that data solely to operate the AI agents and workflows you configure, in line with our Privacy Policy. You are responsible for ensuring you have the necessary rights and permissions to connect any third-party account or dataset to the Service.
6. Intellectual property
The CerebralCrew name, logo, website, product design, and underlying software are the property of CerebralCrew and are protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, branding, or proprietary technology beyond what is necessary to use the Service as intended. Any feedback, suggestions, or feature requests you share with us may be used by CerebralCrew without obligation or compensation to you.
7. Fees and payment (future subscriptions)
CerebralCrew does not currently charge for early access. Once paid subscription plans are introduced, applicable fees, billing cycles, and payment terms will be clearly presented to you before you commit to a paid plan, and separate commercial terms or an order form may apply. No payment information is collected as part of the current early-access registration process.
8. Third-party integrations
The Service is designed to connect with third-party platforms you choose to integrate. We are not responsible for the availability, accuracy, security, or terms of service of those third-party platforms. Your use of any connected third-party service remains subject to that provider's own terms and privacy policy.
9. Disclaimers
The Service, including all content and features made available during the early-access phase, is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that any AI-generated output will be fully accurate — human review is recommended for business-critical decisions made using CerebralCrew's outputs.
10. Limitation of liability
To the maximum extent permitted by applicable law, CerebralCrew and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount, if any, paid by you to CerebralCrew in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold CerebralCrew harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, or your violation of any rights of a third party.
12. Termination
We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms, or if required to do so by law. You may stop using the Service, or request removal from our early-access outreach list, at any time by contacting us. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.
13. Governing law
These Terms are governed by and construed in accordance with applicable law, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will first be addressed through good-faith negotiation between the parties before pursuing formal proceedings, wherever legally required or mutually agreed.
14. Changes to these Terms
As CerebralCrew moves from early access to general availability, these Terms will be updated and expanded to cover platform usage, subscription plans, service-level commitments, and data processing arrangements. We will clearly communicate material changes, and the "last updated" date at the top of this page will always reflect the latest version. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
